The following conditions set out the terms of the contract between MovingMovers GmbH (further referred to as “We” or “Us”) and the Customer (further referred to as “You”). It additionally explains your rights, obligations, and responsibilities as a customer. Any mention of “Goods” refers to the items being removed and/or transported.
1. Price Quotation
Although we quote a fixed price or amount per hour, we reserve the right to amend it or make additional charges if any of the following items have not been taken into account when preparing the quotation:
1.1.1. If due to any circumstances outside our control the work is not carried out or completed within two months of the quotation date.
1.1.2. We are requested to supply any additional services after the price quote has been made.
1.1.3. You fail to send us accurate details and a list of items (e.g., dimensions, weight, etc).
1.1.4. We need to collect or deliver goods above the declared floor or to/from different rooms without prior notice.
1.1.5. By neglecting your responsibilities in Clauses 4.1, 4.3, 4.5, 4.7, 4.9, 4.11.
1.1.6. Access to the collection or delivery point is inadequate, or the approach is unsuitable for our vehicles, or if there are stairs between the parking and the main building door.
1.1.7. If single items weigh over 80 kg, narrow corridor, narrow or spiral staircase, higher ceilings (Altbau), if the distance between staircase/elevator and parking place is more than 15 meters, and if the distance between the apartment and staircases/elevator is more than seven meters.
1.1.8. If there is a fuel shortage or fuel prices rise above the average (applicable for national and international moves, not local moves).
1.2. Hourly Rate
Here are some disclaimers to clarify and for you to better understand how our hourly rate works:
1.2.1. The time starts when we arrive at the pickup address and ends when we receive our payment immediately after the work is completed.
1.2.2. The minimum booking time is one hour for one mover, two hours for two movers, and three hours for three movers. After the aforementioned minimum of hours has been reached, we count additional time in 1-hour increments.
1.2.3. The payment of any parking or other fees or any extra charges incurred and paid to carry out the services are the responsibility of the customer. This includes parking fees, parking tickets, and any other fees incurred during the execution of our services.
1.2.4. The booked hours or the estimated number of hours are to be paid as the minimum (even if we finish earlier).
2. Work Excluded from Our Quotation
Unless previously agreed upon in writing, we will not do:
2.1. The disconnection or reconnection of appliances.
2.2. The removal or re-laying of fitted floor or wall coverings.
2.3. The dismantling or assembly of unit-furniture (flat-pack), fittings, or fitments.
2.4. The moving or transportation of any items, which our working professionals reasonably judge as unable to move safely.
2.5. The clearing driveways or other access areas (at either collection or delivery address) from snow, ice, or any other materials.
3. Excluded Property
The following items are specifically excluded from this contract and will not be moved/transported or insured:
3.1. Jewellery, watches, trinkets, precious stones, money, deeds, securities, works of art, antique furniture, or all kinds of valuable goods.
3.2. Potentially dangerous, damaging, or any kind of explosive items.
3.3. Goods likely to encourage vermin or other pests or to cause infection.
3.4. Refrigerated or frozen food or drinks.
3.5. Any animals and their cages or tanks, pets, plants.
3.6. Furs, perfumery, wines, spirits, tobacco, cigars, cigarettes, foodstuffs, or perishable goods.
3.7. Chemicals and any illegal items.
3.8. Items excluded under German and/or international law.
4. Data Privacy
4.1. We use the data provided by you to fulfill and process the order. The data is passed on to vicarious co-workers and partners, insofar as they are used to fulfill the order. Once the order has been processed in full and payment has been made in full, the data will be blocked for further use and after the tax and commercial regulations have expired.
5. Customer’s Responsibility
It is your sole responsibility as the customer to:
5.1. Obtain, at your expense, all documents necessary for the removal to be completed.
5.2. Be present yourself or appoint a representative at the departure and destination points to ensure that nothing is moved or left in error.
5.3. Pay for any parking fines or meter suspension charges incurred by us in carrying out the work unless otherwise agreed in writing.
5.4. Adequately prepare and stabilize all appliances and sensitive devices prior to their removal (we take no liability for internal damage during transport of all kinds of electronics).
5.5. Secure the closest parking place for our truck to carry the move.
5.6. Ensure that the goods or items you have packed are packed properly and professionally. Please note: items that are packed by yourself or left unpacked are not covered under our insurance incl. water leaks, dust, etc.
5.7. Make sure the weight of all boxes/luggage does not exceed 20 kilograms each; otherwise, extra charges may apply for heavy items.
5.8. Inform us in advance if the boxes exceed the volume of 80L each.
5.9. When booking only one mover, it is obligatory to help and assist in carrying and moving any item that requires two people or more.
5.10. Ensure no dusty, dirty, or smelly items are being transported; otherwise, a professional cleaning fee may apply.
5.11. If required, you must request in advance to have a German speaker mover or a minimum of one German speaker in a team.
5.12. Inform us in advance if your goods exceed the weight limit of 1,000 kilograms when moving with a 20m3 truck (we are not obliged to verify the weight).
5.13. Send us an inventory by latest 48 hours before the move (obligatory for national and international removals).
6. Postponements/Cancellations/Withdrawals Right
If you postpone or cancel this contract, we reserve the right to charge according to how much notice you provide prior to the agreed removal date:
6.1. More than 15 days before the start date of removal: 33% of the removal charge.
6.2. Seven to 15 days before the removal was due to start: 50% of the removal charge.
6.3. Less than seven days before the removal was due to start: up to 100% of the removal charge.
6.4. If we book ferry tickets, accommodation, contractors, or any other services for making the removal, you will be responsible for the charges according to their respective conditions.
6.5. The moving is a service within the meaning of section 312 g (2) sentence 1 nr. 9 BGB. There is therefore no statutory right of withdrawal according to section 355 of the German civil code (BGB).
6.6. For national and international shared loads (Flex date) moves, we reserve the right to postpone or cancel the date if one of the customers from the route cancels on us.
7. Payments
7.1. Please note that payments are due immediately after the job, paid by cash or instant money transfer by bank.
7.2. Normal bank transfers must be completed and received in advance before the job.
7.3. We reserve the right to demand upfront payment before unloading your goods from the truck.
7.4. If you fail to pay, we reserve the right to store your goods on additional charges until the full amount is paid, unless otherwise agreed in writing for late or installment payment.
7.5. A down payment of 33% for local moves and 50% for national and international moves is required unless otherwise clarified in writing between both parties before the date of removal.
7.6. Any fines we might receive due to failing your responsibilities (clause 4) are paid by you.
7.7. Any transaction fees, if required, are paid by you.
7.8. Please note that we only send the proof of payment/invoice per email, which might take up to 48 hours after the payment is completed.
7.9. Tips are not included in the invoice.
8. Our Liability
8.1. If we cause loss or damage to premises or property other than goods for removal as a result of our negligence or breach of contract, our liability shall be limited to reconciling the damaged area/item only or replacing it with an item in similar condition.
8.2. If we cause damage as a result of moving goods under your express instruction, against our advice, and where moving the goods in the manner instructed is likely to cause damage, we shall not be liable.
8.3. The amount of damage for loss or damage to the removal goods is legally limited to an amount of €620 per cubic meter of cargo space in accordance with Section 451 ff. Only the current value of the transported goods is valued, not the new value.
